This application does not form any part of a contract or lease between the applicant and Angus Council. Should your application be approved a formal offer of lease will be sent to you, or your solicitor if acting on your behalf.
Applicants may be subject to a credit history check prior to a lease being offered.
Applicants are deemed to have satisfied themselves as to the condition of the subjects and their suitability for the intended use.
Where applicable, it is the responsibility of the applicant to obtain all licences and permissions (eg, planning permission/building warrant) to operate from the premises, and to meet any costs arising therefrom.
The Council’s legal costs in preparing a lease, together with any registration fees, are payable by the applicant. See relevant property particulars for details.
Any lease entered into is legally binding. It is therefore recommended that applicants seek legal advice before agreeing terms.
New tenants are obliged to participate in a walking-in inspection to enable identification of existing defects in the property for which the tenant will not be liable. Walking-out inspections are also required on termination of the lease, with the tenant being responsible to attend to any other identified defects before handing the unit back.
If applicable, the tenant must complete a Land and Buildings Transaction Tax (LBTT) return and send it to Revenue Scotland within 30 days of the “effective date”. The tenant must pay any tax due and complete further tax returns every 3 years. There are penalties for submitting late returns or making late payments. It is the responsibility of tenants to arrange for connections to services, as appropriate. Business Stream (0845 602 8855), SSE Business Energy (0800 389 4466), and British Telecom (0800 389 2312) could provide these connections, or tenants may choose any other supplier. Tenants are liable for all charges arising from these services, save for all units at Arbroath Business Centre, where rental includes water, wastewater, and surface water drainage, and certain other units at Arbroath Business Centre, where rental also includes electricity and heating.
Tenants must inform Angus Council (01382 536543) of their occupation of premises for the purposes of paying business rates. A discount of up to 100% on the rates payable may be available via the Small Business Bonus Scheme. It is the responsibility of tenants to apply for this, and information and forms can be obtained from Angus Council’s Non-Domestic Rates Section, 01382 536543. To procure bins and arrange collection of commercial waste, tenants should contact Angus Council’s AccessLine on 03452 777 778. Tenants are liable for all charges arising from this service.
